Competition Commission of India cannot decide on patent royalties in cases of abusive behaviours, says High Court of Delhi

The High Court of Delhi has ruled that the Competition Commission of India (CCI) does not have the jurisdiction to decide on patent royalties in cases of abusive behaviors. The court stated that the CCI cannot intervene in matters reserved for the Indian Controller of Patents or Civil Courts. This decision diverges from approaches in the EU, UK, and US, where competition law can scrutinize patent decisions. The ruling may have practical consequences for FRAND-pledged Standard Essential Patents (SEPs) and create increased complexity in the Indian IP/competition interface.
