This working paper examines the applicability of EU design law to emerging forms of digital creation, distribution, and consumption of designs, specifically focusing on the online sharing of digital design files. It discusses the challenges of design rights protection in the digital world and the uncertain liability of online users and platforms. The paper also critiques the recent European Commission Proposal for a Regulation on Community Designs, highlighting its limitations and proposing recommendations for reducing uncertainty and defining the boundaries of design law.
