Vernacare’s patent c-hallen-ged at the Court of Appeal by Hallen v Brabantia principle

The Court of Appeal has ruled in favor of Vernacare Limited in a patent case against Moulded Fibre Products Limited. The appeal overturned the first instance decision and found the patent at issue to be invalid. The judgment focused on claim construction and the inventive concept of the patent. The court concluded that a washbowl made from paper pulp containing a fluorocarbon was obvious to a skilled person. The court also found that claim 9 of the patent lacked inventiveness.
