Federal Circuit Patent Watch: Pending, non-final litigation or IPR decision does not negate intent to infringe that is otherwise supported by evidence

The Federal Circuit ruled in the case of United Therapeutics Corporation v. Liquidia Technologies, Inc. that a pending or non-final litigation or inter partes review (IPR) decision does not eliminate evidence supporting an intent to infringe. The court also upheld the district court's findings of validity and infringement in the case.
