High Court reins in polo-themed trade mark claims

The High Court of England and Wales ruled that the Royal County of Berkshire Polo Club did not infringe on Lifestyle Equities' trademark rights in the BEVERLY HILLS POLO CLUB mark. The court considered the crowded market for polo-themed apparel and the relevance of previous co-existence agreements in its assessment. It found that the marks had low to medium similarity and that there was no likelihood of confusion or infringement. The court also noted the insubstantial evidence of actual confusion.
