Tod's Fights "Knockoff" Trademark Lawsuit With Tacking Argument

Luxury brand Tod's is defending itself against a trademark infringement lawsuit filed by Tribe of Two. Tod's argues that there is no confusion between the two logos and that it has superior rights as it began using its logo before Tribe of Two. Additionally, Tod's is making a tacking argument, claiming that its earlier versions of the logo are similar enough to establish priority. Tod's is seeking to have Tribe of Two's claims dismissed and is requesting damages, a permanent injunction, and cancellation of Tribe of Two's trademark registration.
