JPO Declared Cancellation of Trademark “BORDEAUX WAVE” on Cosmetics

The Japan Patent Office (JPO) has canceled trademark registration number 6576001 for the word mark "BORDEAUX WAVE" in relation to cosmetics. The cancellation was due to the mark being contrary to public policy and accepted principles of morality. The opposition against the mark was filed by INSTITUT NATIONAL DE L'ORIGINE ET DE LAQUALITE and CONSEIL INTERPROFESSIONNEL DUVIN DE BORDEAUX, who argued that the mark misleads consumers and harms the fame and reputation of the Bordeaux wine. The JPO agreed with the opponents' claims and canceled the mark based on Article 4(1)(vii) of the Japan Trademark Law.
